- USER - Natural and legal person who acquires / uses the Service
Regarding the data of the USER:
- FERALBYTE, as the Creator and Service Provider, guarantees that the personal data of the USER are collected for the purpose of becoming available in the FERALBYTE customer database for commercial purposes, billing, marketing of products and services, customer contact, promotion, advertising and for statistical purposes.
- When you use the service, you accept and respond to the needs of your personal data strictly necessary to provide it; such data will be used exclusively for the aforementioned terms.
- In some cases, the personal data of the USER will be disclosed, included or not, without the express consent of the USER, except in the cases provided for in the following paragraph.
- FERALBYTE provide the account information UTILJEFES the matter that it needs to be done by Law or FERALBYTE is notified or summoned judicially for this purpose. FERALBYTE, also, is a portal of your data, in case of non-compliance with the terms and conditions of use of the SERVICE, in the exercise of FERALBYTE's rights in civil, administrative or criminal liability.

Regarding the data that the USER places on TITANTASKS:

The user, as the data controller, has no software to use the SERVICE, expressly states and guarantees that:
- If you see the conditions of legitimacy foreseen in the law for the processing of data of your responsibility.
- It will transmit to FERALBYTE as subordinates to the intended data processing.
- You will only communicate to FERALBYTE the personal data strictly necessary for the execution of the services contracted with FERALBYTE.
- Adopt as technical and organizational measures for the updating and veracity of the data communicated to FERALBYTE.
- Adopts the technical and organizational measures to ensure confidentiality and the security of the data is communicated to Feralbyte in order to prevent its destruction, accidental or illegal, alteration, accidental, propagation or unauthorized access, they are transmitted by network, and are against any form of unlawful processing in accordance with the categories of data processed.
- Has implemented the procedures for the evaluation of the rights of data owners.
- You have implemented the procedures for complying with reporting obligations to the controlling authority and data owners if there is a data breach.
- FERALBYTE as provider of the SERVICE and subcontractor in the processing of personal data, guarantees to the USER that:
- Processing of data communicated to you by the USER only in accordance with the instructions transmitted by the USER, according to the purposes for which the data was collected, and only to ensure compliance with the obligations assumed for the provision of the data. SERVICE and the execution of the operations for that purpose;
- Adopt the necessary and appropriate technical and organizational measures to ensure the confidentiality and security of data and to prevent their accidental, unlawful destruction, alteration, accidental loss, unauthorized dissemination or access, in particular where processing implies their transmission by network, and against any form of illicit treatment;
- It shall keep a record of the processing of data executed on behalf of the USER, which shall contain at least the name and contacts of the USER, other subcontractors and, if applicable, the data protection officer and a description of the data processing performed;
- Limit the access by its employees to the personal data communicated by the USER, being granted only to the extent necessary for the performance of the respective functions assigned to them in the context of the provision of the services;
- Ensure that employees who are given access to personal data are bound by confidentiality obligations in relation to such data and refrain from using them for any other purpose, for their own or others' benefit;
- Perform data processing exclusively in Portugal or in another EU country;
- Provide the USER with the necessary information that demonstrates the fulfillment of its obligations as a subcontractor in the processing of personal data.
- It is the responsibility of the USER to inform the data owners, at the time of their collection, about the purpose of the processing of this data and its communication to FERALBYTE, and, if necessary, to obtain consent for its treatment.
- FERALBYTE undertakes to assist the USER as far as possible to enable it to satisfy the rights of the data owners.
- FERALBYTE is obliged to forward such requests to the USER, as soon as possible, to the e- mail address, if the data subjects submit to FERALBYTE requests for access, rectification, opposition, deletion or portability of their personal data, mail that appears in the data of the USER account.
- FERALBYTE undertakes not to transfer personal data to which it has access to a third party, not even for the purpose of its preservation, except for communication which is necessary at all times in order to maintain hardware and software), and always by signing an agreement to ensure that the third party fulfills its obligations as a subcontractor.
- USER should note that FERALBYTE uses suppliers located in the United States of America, so data uploaded through the SERVICE may be processed in that country. FERALBYTE, by contracting these suppliers for specific data processing operations on behalf of the USER, imposes on them the same data protection obligations as those set out in this privacy policy, in particular the obligation to provide sufficient guarantees to implement appropriate technical and organizational measures in such a way that the treatment meets the requirements of the RGPD.
- In any case, whenever FERALBYTE intends to subcontract third parties, or change subcontracted third parties, it undertakes to inform the CLIENT of this fact. The information to be provided shall include the identification of the third party, the data to be communicated to the third party and the security measures taken to ensure data security.
- FERALBYTE undertakes to notify the USER, without undue delay after becoming aware, of the verification of a violation of personal data.
- This notice shall be accompanied by relevant documentation enabling the USER to notify the competent supervisory authority if necessary.
- The USER will be responsible for notifying the competent supervisory authority in the event of a breach of security.
- FERALBYTE undertakes to keep complete and total confidentiality and confidentiality regarding the personal data it treats in the context of the provision of the SERVICE to the USER and to which it may have access during the execution of the SERVICE. FERALBYTE undertakes not to disclose, publish, or disseminate such information by any means, either directly or through third parties, without the prior written consent of the USER.
- The USER undertakes to respect the confidential nature of the methods and procedures used by FERALBYTE in the provision of the SERVICE and assumes responsibility for the fulfillment of this obligation by its employees. The duty of confidentiality shall not apply to information that is accessible to the general public.
- Upon termination of the SERVICE, FERALBYTE undertakes to return or destroy, as communicated by the USER, any personal data held by it, regardless of the format in which it is stored, except those essential minimum data that must be preserved for the fulfillment of their legal obligations.
FERALBYTE reserves the right at any time to change this privacy policy, notifying the USER at least 24 hours in advance. If you continue to use the SERVICE after this period, those changes will be considered accepted. These conditions are intended to guarantee the user a safe and effective use of the service provided by FERALBYTE.

- It is the responsibility of the USER to inform the data owners, at the time of their collection, about the purpose of the processing of this data and its communication to FERALBYTE, and, if necessary, to obtain consent for its treatment.
- FERALBYTE undertakes to assist the USER as far as possible to enable it to satisfy the rights of the data owners.
- FERALBYTE is obliged to forward such requests to the USER, as soon as possible, to the e- mail address, if the data subjects submit to FERALBYTE requests for access, rectification, opposition, deletion or portability of their personal data, mail that appears in the data of the USER account.
